RULES FOR Quiz and Contests AT INDYASPEAK
The following Terms and Conditions apply to all those choose to participate in any of the activities at IndyaSpeak related to membership or earning money or prizes or at any other affiliate sites of IndyaSpeak. 1. Quiz and Contests @ IndyaSpeak

• IndyaSpeak operates a variety of different Quiz, Contests and other Money Earning Schemes for Artists and other members. Some of these schemes are operated by IndyaSpeak and offered to the Public directly while Some are offered or sponsored by third party. Rules for specific Quiz or Contests are set out in separate schedules.
• Each Participant must register at IndyaSpeak prior to participating in a Quiz or Contests. Some of the Quiz or Contests may be open to general public i.e. they are available to Free as well as Premium members while others are specific to premium members only.
• IndyaSpeak reserves the right to close a Quiz or Contest anytime without any prior notice to its members.
• IndyaSpeak may, at any time at its discretion, refuse to grant permission to play a quiz or contest to any individual Person.
• All funds on deposit with IndyaSpeak will be held in IndyaSpeak’s bank account.
• In case of Quiz or Contest or any other Activity at IndyaSpeak started for Premium Member only, IndyaSpeak will not pay a Prize(s) to which a Participant might otherwise be entitled if the Participant's payment into the Deposit Account is dishonoured in any way or for any reason. IndyaSpeak reserves the right to cancel all outstanding entries for such Participants and to prevent them from playing again.
• IndyaSpeak will not be liable to the Participant for any delay of a Quiz or Contests. A Quiz or Contests may be made by any method established by IndyaSpeak and may be held at any time and place as IndyaSpeak determines. When a Quiz or Contests cannot be held on a fixed date, such Quiz or Contests shall be held as soon as practicable thereafter.
• The Participant may not cancel a registration and IndyaSpeak is not required to provide refunds to Participants, even if the Quiz or Contests has not occurred. Status of the Participant's entry may be confirmed by contacting Quiz or Contests Officers of IndyaSpeak.
• Notwithstanding anything else herein, IndyaSpeak has no obligation to pay or deliver a Prize, unless the Participant holding the Winning Id, if requested by IndyaSpeak, gives satisfactory evidence of identification and/or valid release for the Prize, and undertakes to indemnify and save IndyaSpeak harmless from any further claims made by either such holder or by any other Person regarding such Prize.
• IndyaSpeak has the right to suspend or withdraw any Quiz or Contests at its absolute discretion, including without limitation, a Quiz or Contests that has less than a specified number of Participants.

2. GENERAL

• These Rules and Regulations apply to all Quiz and Contests and all Membership issued under Quiz and Contests conducted and managed by IndyaSpeak. The Rules and Regulations, the conditions and explanations appearing on the Membership and such other conditions as are established by IndyaSpeak, including without restricting the generality of the foregoing, the conditions appearing on IndyaSpeak’s website and price structure statements constitute the contractual rights and obligations with respect to Quiz and Contests conducted and managed by IndyaSpeak. In the event of any discrepancy or inconsistency between these Rules and Regulations and the conditions and explanations appearing on a Ticket or such other conditions established by IndyaSpeak, these Rules and Regulations shall prevail.
• If there is a dispute regarding an entry or eligibility for a Prize or claim, the decision of IndyaSpeak will be final and binding.
• The relationship between the Parties as well as this Agreement is governed by and construed in accordance with the laws of India whose courts shall be the courts of jurisdiction.
• IndyaSpeak reserves the right to amend these Rules and Regulations from time to time and vary any of them without prior notice. Current Rules and Regulations will be posted on IndyaSpeak’s website and such posting will be deemed notice to the Participant. The Participant agrees to periodically review the Rules and Regulations.
• Where the context is required in these Rules and Regulations, the neuter gender shall include the feminine or masculine gender, or vice versa, and singular shall include the plural and vice versa.
• If there is a discrepancy between the English language version of these Rules and Regulations and any other language version the English language version is correct.
• In the event that any of these provisions or the conditions and explanations appearing on a Ticket or IndyaSpeak’s website, or such other conditions as are established by IndyaSpeak are determined by a court of competent jurisdiction to be void or unenforceable, such determination shall solely affect such provision, and shall not in itself, render void or unenforceable the remaining provisions thereof.
• IndyaSpeak, all Quiz and Contests operated by IndyaSpeak and all operations of IndyaSpeak are carried out in accordance with the laws of Panama. The Participants participating in the Quiz or Contests may be subject to laws of other jurisdictions and it is the Participant’s responsibility to ensure that they are authorized to participate in IndyaSpeak’s Quiz and Contests. IndyaSpeak will not be responsible for any losses, taxes, or other costs associated with the Participant’s participation in a Quiz or Contests imposed by any government or other authority. IndyaSpeak does not accept responsibility for any third party claims against the Participants.
• The personal details of the Participants will be collected, used and retained in accordance with IndyaSpeak’s privacy policy.

3. PRIZE CLAIMS

• IndyaSpeak will make reasonable endeavours to contact Winners by e-mail and telephone. In the event of any dispute in regards to a Prize, IndyaSpeak may, in the case of a money Prize, pay the money into court, or as directed by the court, and in the case of any other Prize, deliver the Prize, or evidence of entitlement thereto, to the court, pending determination of the matter by a court of competent jurisdiction.
• A Person who makes a claim for a Prize is conclusively deemed to represent and warrant to IndyaSpeak that he is the Person lawfully entitled to receive such Prize and such representation and warranty shall survive the awarding of the Prize.
• Winners will be asked to show evidence that they are eligible to participate in the Quiz or Contests, and that they are not Ineligible Persons and that they are authorized to use the credit card or debit card in case, a payment is made to IndyaSpeak.
• Except for money Prizes, IndyaSpeak may, at its sole discretion, substitute for any Prize:
  • a cash equivalent to IndyaSpeak’s cost of such Prize; or
  • a Prize of equivalent cost to IndyaSpeak.
• No representation or warranty for fitness or serviceability of any merchandise or service that constitutes a Prize is given by IndyaSpeak and there will be no implied warranties of fitness or serviceability.
• Members may withdraw their earnings by submitting the necessary information required through the “Withdrawal” screen on IndyaSpeak’s applicable website. Payment less than $25 will not be made in any situation.
• Names, photos and country of all of the Winners may be publicized by IndyaSpeak, and the Participant, as a condition to receiving a Prize, will agree to be photographed and the Participant will sign any additional consent in this regard.
• Participants are responsible for withdraw or otherwise using funds that are held in the Participant’s Winnings Account. IndyaSpeak does not undertake to make Participants aware that they have outstanding winnings to collect.
• The Charity Allocation Committee of IndyaSpeak will have sole discretion in selecting appropriate Charities.

4. LIMIT OF LIABILITY

• IndyaSpeak will not be liable for any loss of any nature arising from the cancellation of any Quiz or Contests, including the loss, for whatever reason, of the chance to participate in a Quiz or Contests. In particular, but without prejudice to the generality of the foregoing, IndyaSpeak will not be liable to any person:
  • in the event of force majeure;
  • for the failure of, or damage or destruction to IndyaSpeak’s central computer system or records, or any part thereof;
  • for delays, losses, errors or omissions resulting from failure of any telecommunications or other data transmission system; and
  • for any delay resulting in non-receipt of any entry for a particular Quiz or Contests.
• In all other cases, whether the liability is contractual or in tort, including without limitation negligence on part of IndyaSpeak or its employees, the liability of IndyaSpeak is limited, if the claim is based on a valid Winning , to the cost to IndyaSpeak of the Prize in respect of such Ticket, or otherwise, to the amount paid for registration @ IndyaSpeak.
• Notwithstanding anything else in this Agreement, IndyaSpeak will not be liable for any loss as a result of an act of God, an outbreak of hostilities, riot, civil disturbance, acts of terrorism, the act of any government or authority (including refusal or revocation of any license or consent), fire, explosion, flood, theft, malicious damage, strike, lock-out, or industrial action of any kind.
• IndyaSpeak will not be liable for damages which may be caused by the interception or misuse of the Participant’s credit card details on the Internet.
