The Jammu and Kashmir Reorganisation (Amendment) Bill 2025
Union Home Minister Amit Shah will also move a motion in the Lok Sabha to refer these three bills to a joint committee of Parliament.
Government of Union Territory (Amendment) Bill
According to the statement of objects and reasons of the Government of Union Territory (Amendment) Bill, 2025, there is no provision for the removal of the Chief Minister or Minister in case of arrest and detention on serious criminal charges under the Government of Union Territory Act, 1963.
Therefore, in such cases, an amendment in Section 45 of the Government of Union Territory Act, 1963, is required to remove the Chief Minister or Minister.
Constitution (130th Amendment) Bill
The objectives of the Constitution (130th Amendment) Bill, 2025 state that there is no provision in the Constitution to remove a minister arrested and detained due to serious criminal charges.
Therefore, in such cases, amendment in Articles 75, 164, and 239AA of the Constitution is required to remove the Prime Minister or Union Minister and the Chief Minister or Minister of the States and the National Capital Territory of Delhi.
Jammu and Kashmir Reorganisation (Amendment) Bill
According to the objectives of the Jammu and Kashmir Reorganisation (Amendment) Bill, 2025, there is no provision to remove the Chief Minister or Minister arrested and detained on serious criminal charges under the Jammu and Kashmir Reorganisation Act, 2019. In such cases, an amendment in Section 54 of the Jammu and Kashmir Reorganisation Act, 2019, is required to remove the Chief Minister or Minister.
