Shahrukh Khan's son Aryan's bail plea in the Cruise Drugs Party case is being heard again in Mumbai's Sessions Court today. The hearing will resume in the afternoon after the lunch break. Earlier the proceedings started late due to the late arrival of Additional Solicitor General Anil Singh. He apologized for the delay as soon as he reached the court. Today is Aryan's 7th day in jail.
Updates
ASG Anil Singh told the court that 6 grams of drugs have been recovered from Aryan and his friend Arbaaz and he cannot say that he had any knowledge about it. Both are good friends and both were going to enjoy.
ASG said that I would like to place para 12 of NCB's answer before the court.
Based on the facts, my submission is that Aryan Khan has not taken any drugs for the first time. Records and evidence suggest that he has been regularly consuming banned substances for the past few years.
The ASG said that such a high amount of hard drugs cannot be used for personal use. Quantity can be gauged from chat. The peddler, Qadir, and the foreign national were in touch with Achit Kumar. We are in touch with the ministry to trace the foreign national.
NCB is opposing bail
Earlier on Wednesday, the hearing lasted for about 3 hours, but the debate could not be completed. During this, the defense argued on the sections imposed on the accused from the Panchnama of the Narcotics Control Bureau (NCB) to get Aryan bail, while the NCB opposed the bail and presented its side.
Senior advocate Amit Desai appeared for Aryan and Additional Solicitor General (ASG) Anil Singh appeared for NCB. The ASG said, “The role of one accused in this case cannot be separated from the other.
The NCB has enough material to show that Aryan was in contact with some people abroad, which seems to be part of an international drug network for the illegal purchase of drugs. Some international links related to Aryan have been traced which prima facie point towards illegal drug purchases.
The ASG said that Aryan is an influencer and there is a possibility of tampering with evidence or running away from the law if released on bail. Aryan and Arbaaz Merchant were caught at the International Cruise Green Mumbai, where they cannot enter without the MV Empress card. An investigation is necessary to ascertain all these aspects.
Aryan shifted to common barracks
On Thursday, five other accused, including Aryan Khan, have been shifted from the Quarantine Cell to the Common Cell. Arthur Road Jail Superintendent Nitin Vaychal said that Aryan is not being given home food. They have now been shifted to the common barracks as per the rules.
NCB said – Aryan has an important role in the drugs case
The NCB said that Aryan and another accused had bought drugs from Arbaaz. The NCB also placed a WhatsApp chat in the court and claimed that the investigation of this chat revealed that Aryan Khan had an important role in the drugs case. Their case cannot be treated as isolated, as all of them were part of the rave party. Aryan's lawyer argued that no drugs were found with his client.
Aryan also claims to be in contact with the paddler
NCB told the court that drug smugglers Achint Kumar and Shivraj used to supply charas to Aryan and Arbaaz. To this Aryan's lawyer, Desai argued that NCB was repeatedly talking about drugs and cash, but nothing was found from Aryan. Neither charas nor MD or any bullets or cash was confiscated from Aryan and NCB has seized only 6 grams of charas from Arbaaz.
Desai's allegation – Aryan was forcibly taken a statement
Aryan's lawyer Amit Desai has also described Aryan's confession as a forced statement. Desai said that NCB is saying that Aryan has confessed that he was about to take charas with Arbaaz, but the court also knows how to get things accepted.
