The Income Tax Department has extended the date of submission of the Tax Audit Report without penalty from January 15 to February 15, 2022. The Central Board of Direct Taxes (CBDT) has extended the date of submission of tax audit reports without penalty to February 15 due to the situation arising out of the coronavirus epidemic and continuous technical glitches in the use of the new IT portal. . With this, the date of filing returns for these taxpayers has also been extended from 28 February 2022 to 15 March 2022.
ICAI, the body of chartered accountants, had requested the CBDT chairman to extend the date of filing income tax returns. At the same time, the All Odisha Tax Advocates Association (AOTAA) had sent a legal notice to the Central Board of Direct Taxes for not extending the date of filing the income tax return. Despite the difficulties in the new tax filing website of the Income Tax Department, the association had also sent a notice regarding the late filing fee levied for late filing of return under section 234F of the Income Tax Act, 1961.
The association has written in the notice sent to the CBDT that after receiving this letter, if your office has not extended the dates of filing income tax returns and tax audit reports till 31 March 2022, then the association will file public interest litigation in the Odisha High Court on income tax. Will pray to extend the return dates.
Let us tell you that no relaxation has been given to the taxpayers for whom audit of the tax audit report is not required. The deadline for them to file income tax returns ended on December 31, 2021.
