Sanjay Roy, the beast who raped and murdered a female doctor at RG Kar Medical College, will remain in jail till his last breath. The court sentenced him to life imprisonment under three different sections. All three sentences will run simultaneously. The court has also imposed a fine of Rs 50,000 on Roy. If case of not pay the fine, he will have to undergo an additional jail term of five months. West Bengal CM Mamata Banerjee is not satisfied with the verdict. She said that if Kolkata Police had investigated the case, the beast would have been hanged.
Court's reasoning for not giving death sentence
Additional District and Sessions Judge Anirban Das in Sealdah Court, while pronouncing the sentence on Monday, said that the crime does not fall in the category of rarest of rare, so it is not appropriate to give a death sentence to the culprit. Judge Das said former Kolkata Police volunteer Roy is given life imprisonment for rape under Section 64 and murder under Section 103 (1) of the Indian Penal Code. Also, under section 66, the punishment for causing death, the convict is being sentenced to life imprisonment till death.
The CBI had demanded the death penalty for the convict, while the defense lawyer had requested a prison sentence. It is worth noting that on August 9 last year, a junior doctor was raped and murdered in a medical college. There were protests across the country regarding the incident and doctors agitated for months.
The court raised questions about the police investigation.
Along with this, the Sealdah Court has also sharply criticized the initial investigation of the Kolkata Police in the case. During the hearing, Judge Anirban Das questioned the administration as to why the FIR was registered after 11.30 pm after the brutality with the victim was reported in the morning. In the comments recorded in his judgment, the judge also questioned the purpose of the efforts of the hospital officials to suppress the rape and murder of the doctor on duty.
Judge on police negligence.
During the hearing, the judge expressed his concern mainly on two points. Regarding the negligence of the police during the investigation of the case, he said that the officials of Tala police station did not take the matter seriously at first, which complicated the matter. If the police had taken the right steps in the beginning, this case would not have gotten into so many problems. Also, the judge accused the police officials of indifference to the delay in proper action.
Role of hospital officials
The judge also criticized the hospital officials, who had earlier tried to present this crime as a suicide, so that the hospital could be saved from any consequences. It was also said that when the junior doctors of the hospital protested against it and complained to the principal, then the police started action, but it was too late. Due to this, the victim's parents did not get a chance to see their daughter.
The judge also questioned why the hospital officials tried to hide the information of the case from the police and this act raised doubts about the intention of the hospital administration. In this way, the judge criticized the negligence of both the police and the hospital and the mistakes made at the beginning of the crime.
