The challenge to the Waqf Act: 'There is a system of listing cases, we will hear the case accordingly', CJI told Sibal

The Waqf Amendment Bill has been challenged in the Supreme Court. However, it has been signed by President Draupadi Murmu, making it a law. Six petitions have been filed in the Supreme Court regarding this. Meanwhile, on Monday, in the Supreme Court, senior advocate Kapil Sibal mentioned the petitions challenging the Waqf (Amendment) Bill 2025. On this, Chief Justice Sanjiv Khanna said that he would look at the mentioned letter in the afternoon. He also said that there is a system of listing the cases and the hearing on the petitions will be decided accordingly.

 

Earlier, after being passed by the Lok Sabha and Rajya Sabha during the budget session of Parliament, the Waqf (Amendment) Bill also got the approval of President Murmu on Saturday night. After the President's approval, this bill has now become a law. The central government has also issued a notification in this regard. However, when will it come into force? Its notification will be issued separately by the central government.

 

Which parties filed the petition?

 

Congress MP Mohammad Javed approached the apex court on April 4 challenging the Waqf (Amendment) Bill. Javed was also a member of the Joint Parliamentary Committee on the Waqf (Amendment) Bill, 2024.

 

On April 4, All India Majlis-e-Ittehadul Muslimeen chief and Hyderabad MP Asaduddin Owaisi also approached the Supreme Court against the bill.

 

Aam Aadmi Party (AAP) MLA Amanatullah Khan also approached the Supreme Court (SC) on Saturday challenging the Waqf Bill.

 

An NGO called Association for Protection of Civil Rights has also filed a petition in the Supreme Court opposing the bill.

 

Tamil Nadu Chief Minister MK Stalin's party DMK had also announced to raise the matter in the Supreme Court.

 

A petition has been filed by Samasta Kerala Jamiatul Ulema, a religious organization of Sunni Muslim scholars and clerics of Kerala. The petition has been filed through advocate Zulfikar Ali PS.

 

President Draupadi Murmu approves the bill

 

Meanwhile, President Draupadi Murmu has given her assent to the Waqf (Amendment) Bill. It was passed by Parliament during the budget session. The President has also given his assent to the Muslim Waqf (Repeal) Bill, 2025. The Law Ministry notification issued on Saturday said that the President has given his assent to both bills. On Friday, the Rajya Sabha passed the bill with 128 votes in favour and 95 against, while the Lok Sabha approved the bill on Thursday after a long debate. Here 288 MPs voted in favour and 232 against it.
