The government cannot be held responsible for the effects of the Corona vaccination. The Center has said this by filing an affidavit in the Supreme Court.
The Center said that in cases of death due to vaccines, compensation can be demanded by filing a lawsuit in a civil court. The Center also said that it has sympathies for the deceased and their families, but the government cannot be held responsible for any adverse effect of the vaccine. The Center also emphasized that there is no legal compulsion to get the Covid-19 vaccine.
wrong to hold the government responsible
The Center has given its response to the Supreme Court on the petition filed by the parents on the death of two daughters due to the side effects of the Kovid vaccine. The Ministry of Health and Family Welfare said in an affidavit, the state government cannot be held responsible for paying compensation for deaths caused by the use of the vaccine. It would be legally wrong to do so.
The central government also expressed its deep condolences on the death of the two daughters and said that only one case of vaccine-related death has come to light in the Adverse Effect Following Immunization Committee (AEFI) investigation. Other deaths were not due to the effect of the vaccine.
Health Ministry rejected the demand for compensation
Explain that the Ministry of Health has rejected the petition filed for the demand compensation. The ministry said that if any person suffers bodily injury or death from AEFI, the vaccine beneficiaries or their families can approach the courts to claim compensation for negligence, malafide or wrongful behavior. The Center said the deaths were tragic, but the government cannot be held responsible. In a petition filed on November 23, the health ministry said the government encourages everyone to get vaccinated, but there is no legal compulsion for the same.
two daughters died
The government's reply to the Supreme Court came after a petition was filed by the parents of the two girls. The plea filed by the petitioner's advocate Satya Mitra said that the two daughters died due to side effects of the Covid vaccine. The Supreme Court issued a notice to the Center in August on the parents' petition. The petitioners demanded compensation.
The counsel for the petitioners submitted that the first 18-year-old daughter of the petitioner received her first dose of Covishield in May 2021 and died in June 2021. The second 20-year-old daughter received her first dose of Covishield in June 2021 and died in July 2021.
