A big decision on the Karnataka hijab controversy may come before Supreme Court judge Justice Hemant Gupta retires. According to the information, the top court is preparing to give its verdict on this popular matter this week. In fact, the Supreme Court has challenged the decision of the Karnataka High Court, which upheld the hijab ban in educational institutions.
In the Hijab dispute case, a bench of Justices Hemant Gupta and Sudhanshu Dhulia had reserved its decision on the petitions on 22 September after hearing for 10 days. These petitions are expected to be heard this week as Justice Gupta, who is heading the bench, is due to retire on October 16.
There was a demand to send the matter to the Constitution Bench
During the hearing in the case, lawyers appearing for the petitioners had insisted that preventing Muslim girls from wearing hijab in classes would endanger their studies as they could be prevented from attending classes. At the same time, some lawyers had also requested to send the matter to a five-member Constitution Bench. At the same time, the state government argued that the Karnataka government's decision was religiously neutral.

The Karnataka High Court had on March 15 dismissed petitions filed by Muslim girl students of the Government Pre-University Girls' College in Udupi, seeking permission to wear the hijab inside classrooms. At the same time, the court had said that the hijab is not a part of the compulsory religious practice in Islam. Subsequently, several petitions were filed in the Supreme Court challenging the High Court's decision.
