The Supreme Court has stayed the order of the Yogi government, in which instructions were issued to transfer non-Muslim students studying in unrecognized and government-aided madrasas to government schools.
Jamiat Ulama-e-Hind had filed a petition against this order of the Uttar Pradesh government. This order of the Uttar Pradesh government was based on the report of the National Commission for Protection of Child Rights (NCPCR). It was asked to cancel the recognition of madrasas not following the Right to Education Act 2009 and to investigate all madrasas.
Supreme Court issued notice.
This petition was heard by a bench of CJI DY Chandrachud, Justice JB Pardiwala, and Justice Manoj Mishra. During this, the court said that a notice should be issued regarding this matter. Apart from this, the reports issued by NCPCR on June 7, June 25, and June 27 and all the steps taken after that are stayed.

The National Commission for Protection of Child Rights (NCPCR) recently said in a report that until madrasas comply with the Right to Education Act, the funds given to them should be stopped. NCPCR had said in its report that more attention is given to religious education in madrasas. Due to this children are not able to get the necessary education and they lag.

The opposition had strongly targeted the BJP government on this report. During this, SP chief Akhilesh Yadav accused the BJP of selectively targeting minority institutions. After this, NCPCR Chairman Priyank Kanungo said that he had never demanded the closure of such madrasas, but he had recommended that the government funding given to these institutions should be stopped because they are depriving poor Muslim children of education.
