A petition challenging the Karnataka High Court's decision upholding the ban on hijab in educational institutions was heard in the Supreme Court on Monday. During this, the SC said that it will not accept the petition seeking an adjournment, as there was a demand for an early hearing in the matter. The court issued notice to the state government on a petition seeking a stay on the Karnataka HC's decision while upholding the hijab ban. Now the next hearing on this matter is on Monday, 5 September.
A bench of Justices Hemant Gupta and Sudhanshu Dhulia issued notice to the state on the petitions and listed them for hearing on September 5. The bench expressed displeasure over the demand of some of the petitioners seeking an adjournment in the matter and said that it would not grant such permission.
What is the whole controversy?
The Karnataka High Court had dismissed the petitions of Muslim girl students of 'Government Pre-University Girls College' in Udupi seeking permission to wear hijab in class. The court had said that wearing the hijab is not a part of the essential religious practice in Islam. The court said that the school uniform rule is a reasonable restriction and is constitutionally accepted, on which the girl students cannot raise any objection.
The court had also said that the government has the authority to issue the government order dated February 5, 2022, and there is no case to hold it invalid. In this order, the state government has banned the wearing of those clothes, which disrupts equality, integrity, and public order in schools and colleges. Muslim girls challenged this order in the High Court.
