The UP government has opposed in the Supreme Court the bail of Ashish Mishra, accused of crushing farmers with a car in Lakhimpur Kheri. The state government termed the Lakhimpur Kheri violence in the court as a serious crime. On behalf of the government, it was told in the court that till the trial, in this case, is not completed, Ashish Mishra should not be released from jail on bail. Ashish Mishra is the son of Union Minister of State for Home Ajay Mishra Teni. In the affidavit filed on November 3, the UP government said, "Keeping in view the gravity of the offense and the criminal background of the petitioner and the effect thereof, it would be appropriate that he should not be released from jail till the completion of the trial."
The UP government clearly said that in this case, Ashish Mishra should not be given bail till the trial is completed and the charges are framed. On July 26, the Allahabad High Court refused to grant bail to Ashish Mishra. Ashish Mishra has moved the Supreme Court against the decision of the High Court. The violence took place on October 3, 2021, during the farmers' agitation in Lakhimpur Kheri. During this, there was an allegation that 4 farmers and a journalist were crushed by a car belonging to Ashish Mishra's father. Violence erupted after this incident, in which three other people were also killed.
Ashish Mishra accused of intimidating witnesses
The witness of this case has also opposed the bail granted to Ashish Mishra. Advocate Prashant Bhushan, appearing for the victim's families, said that in March and April this year, people associated with Ashish Mishra had threatened and assaulted the witnesses. He said that this ground is enough to not give bail to Ashish Mishra. During this, the UP government rejected the allegations of the witnesses but did not call the High Court's decision wrong, in which Ashish Mishra was denied bail.
UP government told why it would be wrong to give bail
On the allegations of the witnesses, the UP government said in the court, 'In the investigation, it has been found that there was a fight between the accused and the complainant after the collision of the motorcycle. This incident has no connection with last year's violence in Lakhimpur. The Uttar Pradesh government said that all arrangements have been made for the safety of the relatives and witnesses of the deceased farmers. The state government said that only two things should be kept in mind while granting bail to the accused. The first is the seriousness of the offense and second, the evidence may be tampered with.
