
The Supreme Court on Monday approved the direction of the Central Government to give a compensation of Rs 50,000 to the kin of the Corona deceased. The court said that this compensation to the family of the deceased would be different from other welfare schemes. The court has directed the government to make payment to the family of the deceased within 30 days of the claim. Explain that the compensation will be given from the disaster management fund of the state.
Justice MR Shah said during the hearing on Monday that an amount of Rs 50,000 would be paid to the next of kin of the deceased and it would be more than the amount paid by the Center and the state under various philanthropic schemes.
Justice Shah said that no state shall deny the benefit of Rs 50,000 on the ground that the cause of death in the death certificate is not Covid-19. District officials will take corrective steps to fix the cause of death. The details of the District Level Committee will be published in the print media. Shah has further said that the payment will be from the State Disaster Relief Fund. And the compensation amount will have to be paid within 30 days of the application.
Compensation will be given for deaths even after the date of judgment
Justice MR Shah has also said that ex-gratia assistance will continue to be provided for the deaths even after the date of the judgment. Justice Shah said that the Grievance Redressal Committee can examine the medical record of the deceased patient and call for compensation within 30 days. The committee will have the right to call for the records from the hospitals.
National Disaster Management Authority had recommended
The National Disaster Management Authority (NDMA) has recommended that Rs 50,000 be given to the next of kin of those who died of Covid-19, the Center had informed the Supreme Court last month. The government had said that ex-gratia assistance would also be given to the next of kin of those who died of the virus due to their involvement in activities related to Covid-19 relief work or preparedness to deal with the pandemic.
