Divorce Case: Not living with a husband without solid reason is a kind of torture, court's comment in a divorce case

The Family Court of Madhya Pradesh has made an important comment on a divorce case. The Chief Justice of the court has said that not living with the husband without any valid reason is tantamount to torturing him. This is a kind of cruelty. The court has allowed the divorce application of the husband.

Advocate Manoj Biniwale told that in 2016, Siddheshwar Kumar, a resident of Indore, was married to Kareena Singh of Jaipur. The two met at the matrimonial site and got married a few days later. The husband filed for divorce saying that the wife's behavior changed after marriage. Even on the very first night of the marriage, the wife told him that she is in a relationship with someone else and will continue to do so. Even after this, Siddheshwar accepted her as his wife.

 

Siddheshwar told that he tried a lot to convince his wife, but she did not listen. She would leave the house without informing her husband. Sometimes he would switch off the mobile and sometimes he would not even pick up the phone. Later she said that she will stay with her lover in the future. After this Siddheshwar filed for divorce in court.

In another similar case, the Kerala High Court has observed that repeated taunts by the husband and comparison of his wife with other women are a form of mental cruelty. The Kerala High Court has held that repeated taunts by the husband are not sufficient grounds for divorce. However, the law should take note of this fact. The court was hearing a petition challenging the order of the Family Court.

In a divorce case, the wife had alleged that her husband frequently taunts her. Says that she does not meet his expectations in terms of looks. She disappoints him even compared to other women. The court has said that this is a type of mental cruelty. However, this is not a sufficient reason for divorce.
