The petitions against the hijab ban in Karnataka were heard once again in the Supreme Court today. After the hearing, the Supreme Court reserved the decision. During the hearing, while Advocate General Prabhuling Navadgi presented the arguments on behalf of the Government of Karnataka, senior advocate Salman Khurshid presented the arguments on behalf of the petitioner. The petitions challenging the hijab ban were heard by a bench of Justice Hemant Gupta and Justice Sudhanshu Dhulia.
What is the Hijab Controversy?
Let us tell you that the hijab controversy started in Karnataka when some girl students in a government school in Udupi were barred from wearing hijabs to class. There were many demonstrations in many parts of the country regarding this. Meanwhile, on February 8, inside PES College in Mandya, boys wearing saffron shawls raised slogans of Jayshree Ram. After which the controversy escalated. 19-year-old Muskaan Khan had raised slogans of Allah Hu Akbar in front of a crowd chanting Jai Shri Ram. The matter then reached the Karnataka High Court and the High Court ruled that the hijab was not an integral part of the religion of Islam, so the state government could not be directed to make it a part of the uniform inside the schools.
What was the decision of the Karnataka High Court?
In the Hijab controversy, the Karnataka High Court, while dismissing the petition of the girl students, said that Hijab is not a mandatory part of religion. Students cannot refuse to wear uniforms in school-college. The court said that wearing a hijab is not mandatory in Islam. The court had said that the obligation regarding the school uniform is proper management. The student or student cannot deny it. After the verdict, the security of all the judges has been increased. A bench of Chief Justice Ritu Raj Awasthi, Justice Krishna S Dixit, and Justice JM Khaji was constituted to hear the matter on February 9. A petition was filed on behalf of the girls demanding that they should be allowed to wear hijab even during class, as hijab is an essential part of their religion.
