The case of stand-up comedian Kunal Kamra making objectionable remarks is gaining momentum. The police had registered an FIR against him for making seditious remarks on Maharashtra Deputy Chief Minister Eknath Shinde. Now Kunal Kamra has approached the Bombay High Court seeking a quashing of the FIR. Kamra had moved the High Court on April 5.
His petition claims that the complaints against him violate his fundamental rights to freedom of expression, the right to practice any profession and business, and life and liberty guaranteed under the Constitution of India.
The petition will be heard soon.
The petition filed through advocate Meenaz Kakaliya is likely to be heard on April 21 before a bench headed by Justice Sarang Kotwal. Kamra got interim transit anticipatory bail in the case against him from the Madras High Court last month. He is a permanent resident of Tamil Nadu.
Kunal Kamra did not appear even on the third summons
The comedian was summoned thrice, but he did not appear before the Mumbai Police for questioning. During a show, Kamra had taken a dig at Shinde without naming him. He used a modified version of a Hindi song from the film 'Dil To Pagal Hai', in which he called Shinde a 'traitor'.
The comedian joked about how Shinde rebelled against Uddhav Thackeray. Following a complaint by Shiv Sena MLA Murji Patel, the police here registered an FIR against Kamra under sections 353(1)(b) (making false statements in public) and 356(2) (defamation) of the Indian Penal Code.
