NCB demands removal of comments made while granting bail to Riya Chakraborty, SC said- first oppose bail

The Supreme Court deferred hearing on the petition filed against the order granting bail to Riya Chakraborty in the drugs case. The court said that the petition has not been properly filed. Narcotics Control Bureau should improve it. The judges were concerned that the NCB has challenged the other things said by the High Court without directly challenging the bail.

 

 

Riya Chakraborty was granted regular bail by the Bombay High Court in the drugs case related to the Sushant case. In that order, the High Court had recorded that giving money to someone just to buy the hemp and hiding it from the investigating agency after getting the hemp does not come under the category of trading drugs. Therefore, the case of Section 27A of the NDPS Act is not made on Riya Chakraborty.

 

 

While granting bail to Riya, the High Court had also made some more comments on the case filed by the NCB. On behalf of the bureau today, Solicitor General Tushar Mehta said, "We know that the Supreme Court will not consider revoking the bail. Therefore, they are not challenging it. But our problem is on the other things said by the High Court. "The arguments given by the High Court while granting bail to the accused will affect all the cases related to the NDPS Act."

 

 

Justice SA Bobde, presiding over the three-judge bench, said, "We do not understand this new trend. You have not challenged the bail, but have challenged the other things said while granting the bail. Is the main order Can it be demanded to remove only the comments recorded in the order without challenging it? " The Solicitor General, understanding the court's indication, said that he would rectify the petition and file it again. On this, the court postponed the hearing, saying that the matter should be put up on Monday.
