The interim government of Bangladesh has demanded the extradition of former PM Sheikh Hasina from the Government of India. Regarding this, Mahesh Sachdeva, who was the High Commissioner of India to Bangladesh, said that despite the appeal of the Bangladesh government, the extradition of Sheikh Hasina can be stopped and for this, the former PM of Bangladesh will only have to appeal in the court. In an interview with news agency ANI, Mahesh Sachdeva said that just as many European countries have rejected India's extradition request based on various conditions, in the same way, if Sheikh Hasina approaches the court, India can also refuse extradition citing various reasons.
India can postpone extradition based on these reasons.
It is worth noting that there is an extradition treaty between India and Bangladesh and based on this treaty, the Bangladesh government is demanding to hand over Sheikh Hasina to them. Mahesh Sachdeva said that 'there are many conditions in the extradition treaty between India and Bangladesh which reject extradition in case of political issues. So these conditions exist and these conditions can be used. Bangladesh Prime Minister Sheikh Hasina can go to court against the extradition request and say that she is likely to be treated unfairly. India can also say that we are not sure whether she (Sheikh Hasina) will be treated properly by the justice system.'
Sachdeva said that 'You will remember that extradition of terrorists from Europe to India was sought, but extradition was stopped because the Indian judicial system and Indian prisons were not considered to be up to the standards of Europe. Fugitive industrialist Vijay Mallya has also used these arguments against his extradition.' The extradition treaty between India and Bangladesh was signed in 2013 and amended in 2016. The purpose of this extradition treaty was to deal with the issue of insurgency and terrorism on the common borders of the two countries. However, the extradition treaty between India and Bangladesh also has a condition of refusal of extradition, according to which, if the crime is political, then extradition can be refused.'
