New Delhi, March 24 (IANS) The Delhi High Court on Tuesday restrained a trial court from taking any decision in the defamation case against Congress leader Jagdish Tytler on a complaint filed by advocate H.S. Phoolka who represented the victims of the 1984 anti-Sikh riots in Delhi.
The order by Justice Sunil Gaur came on a plea filed by Tytler challenging the trial court order.
Justice Gaur also issued notice to Phoolka and fixed the matter for August 28.
Tytler challenged the trial court order that framed defamation charges against him for defaming Phoolka.
Phoolka had filed a complaint in 2006, alleging that the Congress leader had made derogatory remarks about him in a news programme aired on September 7, 2004.
Tytler told the Delhi High court that the trial court had framed charges in the defamation case on the basis of a video cassette obtained from a private TV channel, which was not certified as mandated under the Indian Evidence Act and various Supreme Court rulings.
