Presenting the official legal opinion in federal court in Washington, the department explained that the president has immunity for his official acts in office, but can be prosecuted for acts outside his official duties. However, Donald Trump also gave his argument before the court.
What is Donald Trump's argument?
Donald Trump argued that he was acting as president when he told a crowd of supporters that he would never accept the 2020 election and would fight like hell to certify President Joe Biden's election victory.
The Justice Department said the court should reject Donald Trump's argument. The Justice Department said that as the leader of the nation, the president has extraordinary power to speak to his citizens. However, the Justice Department said it is not taking a position on whether Donald Trump's speech encouraged the Capitol riots.
