The Data Protection Bill in India is currently in cold storage. In 2018, the European Union implemented the General Data Protection Regulation (GDPR). This was considered a big step towards increasing cybercrimes and data protection of individuals as well as companies. Since then, work on the Data Protection Bill had started in India as well. The bill, stuck on the amendments and suggestions of the Joint Parliamentary Committee (JPC), has been withdrawn by the government from the Parliament for the time being, but the situation of data protection and cyber security has not improved. Cybercrime cases were more than 27 thousand in 2018, which increased to more than 50 thousand in 2020, that is, almost doubled. The expenditure on cyber security in India in 2019 is about 15 thousand crores. Which has reached 24 thousand crores in 2022. Understand from the figures why India needs a Data Protection Bill.
Cyber Fraud and Identity Theft are the fastest growing crimes… more in southern states
In the total cyber crime cases registered in 2020, the maximum number of 10395 cases were of cyber fraud. Out of this, 4047 cases were directly related to online banking fraud. The second biggest motive of cybercrimes was identity theft, ie identity theft. A total of 5110 cases were registered. One special thing is that 3513 cases of identity theft were registered only in Karnataka, which is more than the rest of the country. At the same time, Telangana has the highest number of 3316 cases of cyber fraud. It is followed by Maharashtra (2032) and Bihar (1294).
Now understand, the mathematics of spending on cyber security in India
Indian banking, finance, insurance, and IT companies spend crores of rupees every year on cyber security. This includes measures such as the cost of private servers, data encryption, and firewalls. Government undertakings also spent Rs 462 crore on cyber security in 2022. However, this expenditure is very less compared to the banking and IT sectors.
Our number after China in the population of Internet users, Smartphone in the hands of 85 crores
India is second only to China in terms of the population of Internet users. In 2022, 66% of the country's population i.e. about 85 crore people are using smartphones. Most of the services related to the health and banking sector are now being used online. Services related to the education and retail sector have also come online during Kovid. In such a situation, it has become very important for citizens and companies to keep their data safe.
The process of complaining about data security breaches in the existing rules is very cumbersome.
Under the new rules, a Data Protection Authority (DPA) will be set up which will hear every complaint.
Every platform that collects data of individuals or companies will have to do DPA registration.
There will be an emphasis on data localization i.e. data companies will have to store the data of Indians on the server in the country itself.
Data protection of private individuals, companies, and the government will all be included in the new bill.
