Cyber Fraud In Madhya Pradesh: Mobile company and the bank found guilty in a fraud case, had to pay damages along with interest

A case of cyber fraud has come to light in Madhya Pradesh. In this case, the victim of fraud neither shared his OTP nor did any online negligence, yet the fraudsters took away Rs 2.92 lakh from his bank account. When the Indore resident account holder was investigated, the negligence of the mobile company and the bank came to the fore. This case of cheating is on August 11, 2018.

 

The account holder filed a case in the IT Court (Court of Adjudicating Officer) located at Bhopal to get the cheated amount. The court found the mobile service provider company and the bank guilty of cheating. After a struggle of four and a half years, the victim finally succeeded in getting the compensation amount of Rs 3.50 lakh along with interest from the mobile company on 30th November 2022. Bank's share amount is still due to be paid.

 

In fact, in the cases of online cyber fraud, the bank account holder's mistake is considered to be the main reason, but many times there is no mistake on the part of the consumer in the use of online banking, payment, ATM card, yet the fraud takes place. In such cases, the responsibility rests with the service providers. The right to compensation is available in the IT Act 2000, but many victims of fraud are not aware of it.

 

Amount transferred as soon as the SIM is switched off

On the evening of August 11, 2018, the BSNL SIM of Sunil Jain, director of Mahaveer Packaging, Indore, suddenly got switched off. On taking information on customer care, the office was asked to issue another SIM the next day saying that there was a fault in the SIM, while his SIM was issued the same evening to a person from Ujjain based on fake documents. It was later learned that soon after the SIM was issued, Rs 2.92 lakh was withdrawn online from Jain's account in the Bank of Baroda. On being duped in this way, the victim got his case registered in the IT court.
