Before the upcoming assembly elections, the ruling party BJP has played a big gamble. No reservation will be given to Scheduled Castes (SC), Scheduled Tribes (ST), and Other Backward Classes (OBC) even in contract jobs in government ministries and departments.
Responding to a writ petition demanding reservation, the Central Government told the Supreme Court that SC, ST, and OBC will be given reservation in contract jobs of 45 days or more in government departments. The Center also said that all ministries and departments have been instructed to strictly implement reservations on temporary posts.
According to the 'Live Law', in respect of appointments to the posts and services of the Central Government, the reservation will be given to SC, ST, and OBC candidates in temporary appointments, which will last for 45 years or more.
The OM references a report of the Parliamentary Committee on the Welfare of SCs and STs. It has been found that not all departments are following the instructions for reservations in temporary jobs.
All ministries and departments are requested to ensure that reservation for Scheduled Castes, Scheduled Tribes, and Other Backward Classes is provided in all temporary appointments lasting 45 days or more, the Center said. All concerned should be informed to follow these instructions.
A bench of Justices Sanjiv Khanna and SVN Bhatti, while disposing of the writ petition, made it clear that if there is a violation of this Office Memorandum, the petitioner or the aggrieved party will be free to take recourse to appropriate remedies as per law.
Along with this, the bench recorded the statement of the lawyer appearing for the Centre. The statement said that a system is in place to deal with cases of failure to comply with the Office Memorandum of 21 November 2012.
