The Supreme Court will today pronounce its verdict on the matter of giving 10 percent reservation in jobs and higher educational institutions to people belonging to the Economically Weaker Section (EWS). The validity of the 103rd Constitutional Amendment providing for EWS reservation has been challenged in court. Chief Justice U.U. Lalit and Justice Dinesh Maheshwari, S. A five-judge constitution bench headed by Ravindra Bhat, Bela M. Trivedi, and JB Pardiwala have reserved the verdict on the matter.
the hearing lasted for seven days
The marathon hearing in the case lasted for about seven days, where senior lawyers argued in favor of the petitioners after which (then) Attorney General K.K. Venugopal and Solicitor General Tushar Mehta put forth their arguments in defense of the EWS quota.
The government defended the law
In the petitions filed in the Supreme Court, there has been a demand to quash the reservation on economic grounds, saying that it is against the basic structure of the Constitution. The government supported the law in court, saying that this law provides for reservations for the very poor. In this sense, it strengthens the basic structure of the Constitution. This gives meaning to the concept of economic justice. Therefore, it cannot be said to be violative of the basic structure. At the very beginning of the hearing, the Supreme Court had fixed constitutional questions for consideration.
The petitioner said - this is a fraud from the constitution
Legal scholar Dr. G. Mohan Gopal, representing one of the petitioners, argued that the division of classes, the quality of being required as a pre-requisite for granting reservation, contradicts the basic structure of the Constitution. Earlier, Gopal had argued that the 103rd Amendment is a fraud on the Constitution and the ground reality is that it is dividing the country based on caste.
