Along with interference in the coal business and government contracts, the beating of Mukhtar Ansari's henchmen in the district jail became an important reason for the murder of history-sheeter Awadhesh Rai of Chetganj police station. The dominance of Awadhesh Rai, accused of 19 cases registered on other criminal charges including murder, was increasing rapidly in Purvanchal via Varanasi to Ghazipur.
In the nineties, when the Mukhtar Ansari gang started spreading its foot in Banaras, a domineering type of Awadhesh Rai was a big obstacle in their path. When the Mukhtar Ansari gang demanded extortion money from the traders of Banaras, Awadhesh Rai used to stand as a shield. As a result, Awadhesh Rai was murdered in front of his house on August 3, 1991, in a planned manner by hatching a conspiracy to remove him from the road.
In fact, in the year 1990, Awadhesh Rai and the elder brother of a former MLC were lodged in the district jail of Varanasi. During that time some members of Mukhtar Ansari's gang were also in this jail. Mukhtar Ansari's henchmen had an altercation with the former MLC's elder brother over something and the matter reached a fight. The elder brother of the former MLC sought help from Awadhesh Rai. On this Awadhesh Rai thrashed Mukhtar Ansari's associates behind bars. After this incident, Mukhtar Ansari got so upset that he decided to keep Awadhesh as a hideout. Reiki was done first, and Awadhesh was shot dead. After this, the miscreants left their vehicle and fled through the streets.
awadh's criminal history was shielded by the defense
During the hearing in the court, the defense had made 19 cases registered against Awadhesh Rai in other criminal cases including murder as their shield. The details of 10 cases registered in Chetganj police station, six in Sigra police station, two in Cantt, and one in Shivpur were also presented by the counsel for the accused in the court. In this, it was said on behalf of Mukhtar that the terror of Awadhesh Rai was prevailing in the society and he had many enemies. Before this incident, the enemies had filed several cases against the deceased.
Mukhtar had accused the deputy city chief
During the hearing, Mukhtar Ansari's side had said in its defense that Awadhesh Rai had a grudge against deputy city chief Anil Singh. In such a situation, Anil Singh must have got Awadhesh Rai murdered. In this, the defense also argued that Anil Singh was killed after the murder of Awadhesh Rai. It was an act of revenge between the two gangs. However, the court considered this argument baseless due to a lack of evidence.
The court considered Mukhtar's absconding as a relevant fact
The prosecution proved in the court that the accused Mukhtar Ansari had absconded after the incident. Action under 82 and 83 of CrPC was also taken against him. The Court has considered this behavior of Mukhtar Ansari as evidence and has accepted it as a relevant fact in proving the crime.
