The Supreme Court has stayed the Bombay High Court's acquittal of former Delhi University professor GN Saibaba. A bench of Justice MR Shah and Justice Bela M Trivedi said that the matter needs a detailed hearing, so Saibaba will not be able to get out of jail right now.
During the hearing in the Supreme Court, Senior Advocate R Basant, appearing for Saibaba, said that the former professor is in jail for 8 years. He is 55 years old and 90% of his body is not functioning. Saibaba walks in a wheelchair, so he should not be kept in jail anymore. On this, the court said that to be involved in terrorist and Naxalite activities, the brain is needed, not the body.
The Bombay High Court had acquitted on 14 October.
Saibaba was acquitted by the Nagpur Bench of the Bombay High Court on October 14. The court had said that Saibaba should be released from jail immediately. After the acquittal of GN Saibaba from the High Court, Tushar Mehta went to the bench of Justice DY Chandrachud on behalf of the Maharashtra government.
Mehta said – Saibaba has been released on technical grounds. If they come out of jail then it will be dangerous for the country. Saibaba has connections with Maoists. Justice Chandrachud said that if you go to the Chief Justice for an urgent hearing, we cannot stay the release.
Gadchiroli court found guilty in 2017
The Gadchiroli Court in Maharashtra 2017 convicted Saibaba and five others under the UAPA and the Indian Penal Code. Saibaba and four others were sentenced to life imprisonment and one to ten years imprisonment. Saibaba filed an appeal in the Bombay High Court against the decision of the Gadchiroli Court.
Arrested for connection with Maoism
In 2013, in Gadchiroli, Maharashtra, the police arrested Mahesh Tirkey, P. Narote, and Hem Mishra, associated with Maoists. After interrogating these three, the police went to court against GN Saibaba. Saibaba was arrested from his Delhi residence on 9 May 2014 on charges of connection with Maoists. In 2015, proceedings were started against Saibaba by registering a case under UAPA.
