Gujarat's Surat district court has sentenced former Congress president Rahul Gandhi in a four-year-old defamation case. The Surat court convicted Rahul and sentenced him to two years imprisonment. This matter is related to the controversial comment made on the Modi surname. In fact, before the Lok Sabha elections in 2019, Rahul Gandhi had said during a rally in Kolar, Karnataka, "Why do Nirav Modi, Lalit Modi, and Narendra Modi have the same surname? Why do all thieves have Modi as their surname?" A complaint was filed by BJP MLA and former Gujarat minister Purnesh Modi regarding this remark of Rahul. A criminal defamation case was filed against Rahul. The BJP leader said that Rahul Gandhi defamed the entire Modi community with this comment.

 

Will Rahul Gandhi lose Lok Sabha membership?

If Rahul Gandhi was sentenced to more than two years, then his membership in Parliament could be in danger. Kerala's Wayanad Lok Sabha MP Rahul Gandhi has been sentenced to two years in prison by the court. In such a situation, his membership in Parliament will remain intact. According to a decision of the Supreme Court, if MLAs or MPs are punished for more than two years in any case, then their membership in Parliament or Legislative Assembly will be taken away.

 

What options does Rahul Gandhi have?

While granting bail to Rahul Gandhi, the Surat court suspended the sentence for 30 days. That is, they have got time from the court to apply to the higher court. Rahul can appeal against the sentence. However, they have to file a petition in court within 30 days.
