The hearing on the Waqf law was held in the country's biggest court on Wednesday. It lasted about 70 minutes. During this, the Supreme Court's comment on the Waqf law increased the central government's difficulties.
During the hearing in the Supreme Court, the petitioners who filed the petition against the Waqf law presented their arguments. At the same time, the central government also presented its side in defense of the law. During this, the Supreme Court also asked sharp questions to the central government regarding the Waqf law. Today also, the hearing on this matter is going to be held, then the picture will become clear.
On Wednesday, all kinds of arguments were given and reasoning was presented in the Supreme Court. Before knowing what happened during the hearing on Wednesday, let us know why the Supreme Court stopped itself from issuing an interim order yesterday. Why did the court decide to continue the hearing before the interim order?
What happened in the court on Wednesday?
An interim order could have come on Wednesday regarding the three amendments related to the Waqf law.
First issue- denotification of Waqf by user properties.
Second issue- Inclusion of non-Muslim members in Waqf Board.
Third issue- Collector gets rights in dispute of Waqf property.
The central government appealed to hear its arguments before issuing an interim order.
Due to a lack of time, the Supreme Court postponed the hearing of the Waqf law.
On Wednesday, the hearing on Waqf law went on for about 70 minutes in the Supreme Court. This made one thing clear the Supreme Court will issue an interim order regarding this law. But it is not clear yet what will be in the interim order. Will the Supreme Court ban the Waqf law?
CJI asked sharp questions to the Center
During the 70-minute hearing on Waqf law, Chief Justice Sanjeev Khanna asked many sharp questions to the Central Government. This has made the picture a little clear that after today's hearing, the court should issue an interim order regarding the three resources of Waqf law.
What arguments were given regarding the Waqf law?
During the hearing on Wednesday, Kapil Sibal first said, "It is not that easy, Waqf was created hundreds of years ago, now they will ask for a Waqf deed of three hundred years old property, there is a problem here." On this, the Supreme Court said, "Why was Waqf by user removed, there are many old mosques. There are mosques of the 14th and 16th century, which will not have registration sale deed. How will such properties be registered?"
The court further said, "If such Waqf is rejected, the dispute will last longer. We know that some of the old law was misused, but there are some genuine Waqf properties. If we abolish it, there will be a problem."
On the question of the Supreme Court, Tushar Mehta said that if any property is registered as Waqf property, then it will remain a Waqf property. No one has been stopped from registration. Registration of property was mandatory in the first law that came in 1923. It was also mandatory in 1954 and 1995. Changes were made in 2013, in that too registration was mandatory.
Supreme Court asked sharp questions.
First question- If a property is by-user and it is not registered, then what will happen to it?
Second question- What does it mean for a property to be in dispute?
Third question- Before the British, there was no provision for registration, what would happen in such a case?
Fourth question- If a property is Waqf by-user, then what will happen in that situation?
The central government answered the court's questions.
First answer- The collector will investigate it and if it is found that it is government property, then it will be corrected in the revenue records.
Second answer- If someone has a problem with the collector's decision, then he can go to the tribunal.
The hearing will continue today as well.
Many sharp questions were asked to the central government during the hearing on Wednesday. The court also raised questions about the powers given to the collector under the new law. Now today this matter will be heard again in the Supreme Court and the central government will answer the questions of the Supreme Court. Now it will be interesting to see what interim order the Supreme Court issues regarding the Waqf law.
