Rejecting the petition to quash the arrest, the court said, it could not be said that the arrest was made without any justifiable reason. However, the court allowed Kejriwal to go to the lower court for bail. Kejriwal had directly approached the High Court for bail.
The High Court on Monday refused to decide on the merits of the bail case and asked the Chief Minister to go to the trial court. "As far as the bail plea is concerned, it is disposed of with liberty to approach the trial court," the court directed.
The CBI arrested Kejriwal on June 26 when he was in judicial custody in connection with a money laundering case being probed by the Enforcement Directorate (ED). He was later granted interim bail by the Supreme Court in the ED case but will remain in jail as he has not yet been granted bail in the CBI case.
