
In an important decision, the Supreme Court has strictly ordered social media influencer, famous comedian Samay Raina, and others to apologize for making fun of the disabled.
The court clearly said that appropriate punishment and fine will also be imposed for such acts. This matter came to light during the hearing on the petition of SMA Cure Foundation. The petition accused the comedians of making insensitive remarks against the disabled.
According to Live and Law, the petition includes the names of Samay Raina, Vipun Goyal, Balraj Paramjit Singh Ghai, Sonali Thakkar, and Nishant Jagdish Tanwar. They are accused of making such comments in their programs and podcasts, which hurt the dignity of the disabled. This petition is being heard by Justice Surya Kant and Justice Joymalya Bagchi.
Supreme Court's direction to the Center
This petition has also been linked with the cases of Ranveer Allahbadia and Ashish Chanchlani, who are associated with the 'India's Got Latent' controversy. Both have demanded to combine the FIRs registered against them be combined. The court allowed the central government to be made a party and asked the Attorney General to prepare such guidelines that protect the rights of all and do not hurt anyone's dignity, honor, or self-respect.
The petitioner, SMA Cure Foundation, will be actively consulted in making the guidelines. The court also said that suggestions should also be taken from other stakeholders. The guidelines should not be a reaction to any one incident, but should be comprehensive, keeping in mind future needs.
Order of apology to comedians
The court accepted the submission made by the lawyer of Samay Raina and other comedians (respondents no. 6 to 10) that all of them will post an apology on their YouTube channel and other social media platforms. Along with this, on the suggestion of SMA Cure Foundation, these comedians will also have to file an affidavit. At present, the court has exempted them from personal appearance, provided they follow their promise.
The court also clarified that the question of appropriate punishment or fine on these private respondents will be considered later.
