The political crisis in Maharashtra has not ended completely even after Shiv Sena's rebel faction leader Eknath Shinde became the Chief Minister and BJP leader Devendra Fadnavis became the Deputy CM. The process of political and legal bets continues. The Uddhav Thackeray camp, led by Sunil Prabhu, moved the Supreme Court seeking the suspension of 16 MLAs, including Eknath Shinde, from the Assembly till the proceedings for their disqualification are decided. Prabhu also requested a direction to stop all of them from entering the assembly. However, the court refused to hear the matter urgently.
Shiv Sena Chief Whip Sunil Prabhu today filed an application in the Supreme Court seeking to stop CM Shinde and 15 MLAs supporting him from entering the house tomorrow. The party says that unless the disqualification notices received by these MLAs from the deputy speaker are decided, then they cannot be allowed to enter the assembly. Shinde should also be barred from the majority test till then. Since the special session of the Maharashtra Legislative Assembly will be held on July 2 and 3 and the Supreme Court has refused an urgent hearing on the fresh application, Shinde has got a big relief for the time being.
Senior advocate Kapil Sibal, appearing for Shiv Sena, mentioned the petition before the Supreme Court today and sought an early hearing. The Supreme Court refused an early hearing and said July 11 is ready to consider the petition.
The disqualification notice given by the deputy speaker has been challenged in the Supreme Court by the rebel group led by Shinde. On this, the court issued notice to the parties and fixed the further hearing for July 11. No decision has been taken yet on the disqualification of the MLAs, so their legislature remains intact.
Earlier, the Shiv Sena had challenged Governor BC Koshyari's order to earn the trust of the Assembly to the Uddhav Thackeray government. Governor Koshyari had directed the then CM Uddhav Thackeray to seek a trust vote in the assembly on June 30. On this, the Supreme Court had upheld the Governor's order after a long debate on June 29 and Thackeray resigned from the post of CM soon after.
a special session of the assembly from tomorrow
After Thackeray resigned from the post of CM on June 29, there was no need for a trust vote and on the evening of June 30, Shiv Sena's rebel leader Shinde was administered the oath of office by the governor. Former CM Devendra Fadnavis took oath as the Deputy CM. After this, Chief Minister Shinde held the first meeting of the cabinet on Thursday night and has decided to convene a special session of the assembly on July 2 and 3. During this, Shinde can seek the trust vote. The Speaker can also be elected in a special session only. Shiv Sena had reached the Supreme Court with a fresh application to obstruct the same process.
