Uddhav Thackeray has to resign from the post of CM. Eknath Shinde's lawyer raised questions in SC

Did Shiv Sena Chief Uddhav Thackeray make a mistake by resigning from the post of CM? Eknath Shinde's lawyer Mahesh Jethmalani, during the hearing on Shiv Sena's claim in the Supreme Court on Wednesday, raised this question. Jethmalani said that Uddhav Thackeray's resignation meant that the government did not have a majority. Mahesh Jethmalani told the Supreme Court that the new government was formed after the resignation of Uddhav Thackeray. It is clear from his argument that Uddhav Thackeray's resignation is a big turning point in the politics of Maharashtra. It is believed that due to his resignation, the arguments of Shiv Sena against the Eknath Shinde government are weakening in the Supreme Court.

 

Senior Congress leader and former CM Prithviraj Chavan had said during the resignation of Uddhav Thackeray that this is a mistake. He had clearly said that Uddhav Thackeray has made a big mistake by resigning from the post of Chief Minister in a hurry. Now, Jethmalani's argument in the Supreme Court has proved his remark to be true. Mahesh Jethmalani, counsel for the Shinde faction, emphasized these two points during today's hearing. The then Chief Minister Uddhav Thackeray was defeated in the test of the majority. The new government was formed after Uddhav Thackeray resigned from the post of Chief Minister. Jethmalani said if the chief minister refuses to face the test of the majority, it is assumed that he does not have a majority.

 

Why did Prithviraj Chavan raise questions about Uddhav's resignation?

 

Hence the discussion has started on whether Uddhav Thackeray's resignation from the post of Chief Minister without facing the majority test was a big mistake. However, it is believed that Uddhav Thackeray thought it appropriate to resign instead of facing cross-voting of MLAs in the assembly. Former Chief Minister Prithviraj Chavan had said that Uddhav Thackeray had an opportunity to take strong action under the anti-defection law, but the haste in which he resigned from the post of Chief Minister was a big mistake in my view. Now some similar questions have also arisen from the hearing of the Supreme Court.

 

Uddhav faction also ditched the assembly speaker's election

 

Eknath Shinde's lawyers in the Supreme Court said that the law of defection does not apply to him. The reason for this is that these people have not only left Shiv Sena but want to change the leadership of the party. Not only this, but Mahesh Jethmalani also answered the questions regarding the election of the Speaker of the Assembly. He said that the old government had not elected the Speaker of the Legislative Assembly even after a lapse of more than a year. He said that according to the Constitution, the new government is allowed to elect the Speaker of the Legislative Assembly. A new government came into existence after the resignation of the Chief Minister. After that, the new Speaker was elected in the Legislative Assembly by a margin of 164 to 99.
