The Supreme Court will hear many important cases on Tuesday including the bulldozer campaign, Sri Krishna Janmabhoomi-Shahi Idgah dispute in Mathura, Kolkata doctor rape-murder.
According to the list of cases of September 17 uploaded on the Supreme Court website, a bench of Justice BR Gavai and Justice KV Vishwanathan will hear the petitions filed against the action of the administration in many states to demolish the properties of the accused by running bulldozers on their houses.
While hearing these petitions on September 2, the apex court raised the question of how can someone's house be demolished just because he is an accused. It also said that even if he is guilty, this cannot be done without following the procedure prescribed by law.
The apex court had said that it would set some guidelines on this issue which would be applicable across the country. However, the court had also said that it would not protect unauthorized construction or encroachment.
Shahi Masjid Idgah Management Trust Committee's petition will be heard.
The apex court will hear on Tuesday the Muslim side's petition against the Allahabad High Court's order in which its petition challenging the maintainability of 18 cases related to the Krishna Janmabhoomi-Shahi Idgah dispute in Mathura was dismissed. A bench of Justices Sanjiv Khanna and Sanjay Kumar will hear the petition filed by the Shahi Masjid Idgah Management Trust Committee against the August 1 order of the High Court.
Bengal doctor rape case will also be heard.
Meanwhile, amid the ongoing protests by doctors in Bengal, the apex court will also hear on Tuesday its suo motu case of rape and murder of a resident doctor at Kolkata's RG Kar Medical College-Hospital.
This hearing is also important because the resident doctors are still on strike while the apex court had directed them to return to work by 5 pm on September 10 to avoid punitive action by the state government. During the hearing, the government had claimed that 23 patients died till September 9 due to their absence from work.
A three-judge bench headed by CJI DY Chandrachud will also consider the latest status report of the CBI. In another case, the apex court will also hear a petition filed by Suheldev Bharatiya Samaj Party MLA Abbas Ansari against the imposition of the stringent Gangster Act by the Uttar Pradesh Police.
