Court angry with Maharashtra government in transgender recruitment case: expressed displeasure over not keeping two posts, warned to stop the recruitment process

The Bombay High Court has pulled up the Maharashtra government for creating posts for transgenders under the Home Department. Chief Justice Dipankar Datta's bench said that the government is sleeping backward on this issue. He expressed displeasure over not keeping two posts for transgenders and Justice Dipankar warned to stop the entire recruitment process.

 

On Thursday, the bench was hearing the government's petition. The petition challenges the State Administrative Tribunal's direction to make provisions for transgenders in the application form.

Transgender Arya Pujari tried to apply online after the advertisement for the recruitment of police constable was released, but he was not able to fill out the form as there was no option for the third gender. Due to this, the priests could not fill out the online form. In the matter, he complained to the Maharashtra Administration Tribunal (MAT).

 

The tribunal had directed the state government to ensure that transgenders can fill out the form. They can get a chance to get recruited. It also directed the state government to fix a set of criteria for physical standards and tests for transgenders.

 

The state government has not made any policy for the recruitment of transgenders.

The state government approached the High Court against the MAT's order, stating that their recruitment process is already underway and they cannot recruit transgenders at this point. The government, in its plea, said that it was extremely difficult to implement the tribunal's direction as it has not yet framed any policy regarding special provisions for the recruitment of transgenders.

 

Explain that in 2014, the Supreme Court had asked for the recruitment of transgenders during the recruitment of public posts. Many states have implemented this rule while Maharashtra is yet to implement the apex court's order.
