Supreme Court on Farmers Protest: The Supreme Court today asked that when it has put a stay on agricultural laws and the Center has also said that it does not want to implement them at present, then what is the protest going on? The court has said that it will hear the aspect that if someone approaches the court on any issue, should he still be allowed to protest on the street?
An organization named Kisan Mahapanchayat had sought permission for Satyagraha in protest against agricultural laws at Delhi's Jantar Mantar. In the hearing held last week, the Supreme Court had asked the organization whether it was also involved in the ongoing protests by closing the highway for months. Filing an affidavit on behalf of the organization today, it was told that he is not involved in the organizations sitting on the road blocking the Delhi border. He wants to conduct Satyagraha at Jantar Mantar.
A bench of Justices AM Khanwilkar and CT Ravikumar said, "But you have challenged the agricultural laws in the Rajasthan High Court. Once you have raised an issue in court, how can you protest after that? The court said that it will transfer the petition of the Kisan Mahapanchayat to itself from the Rajasthan High Court and it will also be heard along with other pending petitions on the issue.
During the hearing, Attorney General KK Venugopal referred to the accident that happened in Lakhimpur Kheri in UP yesterday. He said, "The protests are going on even after the matter is pending in the court and the implementation of laws has been stopped by the government. Such an unfortunate incident has happened due to such unnecessary demonstrations." To this, the judges said, "But the problem is that when such an incident happens, no one wants to take responsibility for it."
Solicitor General Tushar Mehta also said that when a case is being heard in the highest court of the country, then everyone should wait. They should have faith in the court. At the end of the hearing, the Supreme Court transferred the case pending in the Rajasthan High Court to itself. The court said that it will first hear this aspect of whether a petitioner can protest on the road while the matter is pending in the court. Is the right to protest available to a person at all times? The next hearing of the case will take place on October 21.
