In the earlier hearing, the High Court had rejected the application of the Faridabad Industries Association, in which the industry had sought a hearing on their petition against reservation before January 15, as the Act was to be implemented in Haryana from January 15. . The industry had filed an application saying that if it is heard after January 15, then there will be no justification for their petition, so either the act should stay or it should be heard soon, but the High Court said that this But the hearing will take place only in February.
The Act providing 75 percent reservation in private sector jobs to the residents of Haryana was challenged by the Faridabad Industries Association and others. In this case, the High Court has issued a notice to the government asking why it should not put a stay on this act of the government, but the hearing is to be held in February. In the petition filed in this case, there was a demand to repeal the Employment Act 2020. It was feared in the petition that due to the implementation of this law, there may be migration of industry from Haryana and there is a violation of the rights of youth with genuine skills.
According to the petition, this decision of the Haryana government is unfair to merit. Selecting youth for jobs from the reserved sector instead of open will have an adverse effect. This decision of the government is out of the jurisdiction and against many decisions of the Supreme Court, so it should be quashed. According to the petition, the state Haryana government is giving reservations in the private sector under the son of the earth policy, which is a violation of the constitutional rights of the employers, as the private sector jobs are purely based on merit and skill. The High Court has put a stay on the reservation today.
