
New Delhi, Feb 8 (IANS) A Delhi court has ordered a man to pay Rs.15,000 per month towards rent for house of his estranged wife.
However, the court denied to grant immediate accommodation to the woman in the man's five-storey house in south Delhi, observing that it may impact the right of tenants residing there.
Additional Sessions Judge Raj Kapoor passed the order Thursday while hearing an appeal by Vipin Panwar and his family members against a magisterial court's order that directed them to take steps to vacate one of the rooms in their home.
In November 2014, the magisterial court ordered the Panwar family to take steps to vacate one of the rooms of their residential premises at Shahpur Jat Village and give it to Vipin Panwar's estranged wife for her residential purpose.
In Thursday's ruling, the judge observed that rooms on the third and fourth floors are already under tenancy, which may impact the rights of the tenants without hearing them.
"So, in my view end of justice will be met if alternatively the appellants (Panwar family) are directed to pay total sum of Rs.15,000 per month as rent to the respondent so as to enable her to live according to her just choice from November 2014 till the residence either third or fourth floor of the said premises of property gets vacated in accordance with law," Justice Kapoor said.
Vipin Panwar's counsel opposed the plea and told court that the woman is taking maintenance of Rs.4000 per month besides Rs.4 lakh as final settlement.
The woman got married to Vipin Panwar in February 2007.
Soon after the marriage, she was subjected to domestic violence by her in-laws. She left her matrimonial house in December 2008 after beating by her husband and other family members and went to her parental home.
