Rahul Gandhi: The High Court justified the lower court's decision, knowing what it said while upholding Rahul's sentence

The Gujarat High Court upheld the conviction of Rahul Gandhi. Justice Hemant Prachhak dismissed Rahul Gandhi's plea seeking a stay on his sentence, saying at least 10 criminal cases were pending against him. Even after the present case, some other cases were also registered against him. One such case has been filed by the grandson of Veer Savarkar.

 

Justice further said that no injustice will be done by the conviction. The conviction is just and proper. There is no need to interfere with the order passed earlier. Therefore the application is dismissed.

 

Significantly, Congress leader Rahul Gandhi was held guilty in a criminal defamation case for his remark using the surname Modi. He was sentenced to two years, after which he lost his membership in Parliament. Now the High Court has also given them a blow. This would prevent him from contesting elections or seeking revocation of the suspension of his status as a Member of Parliament (MP). However, he can appeal to the Supreme Court against the order of the High Court.

 

Rahul should not create such a history

At the same time, BJP MLA Puransh Modi welcomed the decision of the High Court. He said on the court's remark that more cases will be registered against Rahul, Rahul should think about it and should not create such history….

 

Interim relief was not received in May

Earlier, Justice Prachchak had refused to grant interim relief to Rahul Gandhi while hearing his petition in May. He had said that he would pass the final order after the summer vacation.

 

Rahul's lawyer gave this argument

Rahul Gandhi's counsel had argued in the Gujarat High Court during a hearing on April 29 that a maximum sentence of two years for a bailable and non-cognizable offense would mean his client would lose his Lok Sabha seat.

 

Was sentenced to two years in March

In fact, in March 2019, in connection with the remarks made by Rahul Gandhi regarding the Modi surname, the Surat court sentenced him to two years under section 504. After this, Rahul's Lok Sabha membership also went away. In such a situation, if the decision comes in favor of Rahul from the High Court, then the way will be paved for the restoration of the Congress leader's membership of Parliament.

 

What did Rahul say?

In fact, during the 2019 Lok Sabha elections, at a rally in Kolar, Karnataka, Rahul Gandhi had said, 'How come all thieves have Modi as their surname?' Regarding this, BJP MLA and former Gujarat minister Purnesh Modi had filed a defamation case against Rahul Gandhi. He alleged that Rahul had defamed the entire Modi community with his remarks. A case was registered against Rahul under IPC sections 499 and 500 (defamation).
