Jharkhand High Court Justice SK Dwivedi's bench has said that under the Muslim Personal Law, a Muslim girl of 15 years or above is free to marry a man of her choice. The court said these things while canceling the FIR lodged against the youth who married a 15-year-old girl and the action of the lower court.
Muslim girls can do this according to Muslim personal law
The High Court said in its decision that the marriage of a Muslim girl takes place under Muslim Personal Law. In such a situation, a 15-year-old girl is free to marry the person of her choice. In this regard, Mohammad Sonu had filed a quashing petition in the Jharkhand High Court challenging the FIR. An FIR was lodged against him by the girl's father alleging that he had tricked her into marrying.
The girl is from Jamshedpur, the boy is from Bihar
The girl is from Jugsalai in Jamshedpur and Sonu is from Nawada in Bihar. During the hearing, the girl's father filed an affidavit in the court saying that he had no problem with his daughter's marriage. Due to some misunderstanding, an FIR was lodged against Sonu.
Both families gave their consent for the marriage.
During the hearing, the advocate on behalf of the girl told the court that this marriage has been approved by both families. After this, the court quashed the FIR against the youth.
