The special-cell team of Delhi Police on Tuesday produced Deep Sidhu after arresting him in a Delhi court and demanded 10 days police custody, but the court sent him to 7 days police custody. Delhi Police told Metropolitan Magistrate Pragya Gupta that Deep Sidhu was the main instigator of the violence. Deep allegedly instigated the crowd not to follow the accepted route of the Farmers Parade and broke the barricade with tractors on 26 January.

The police alleged that Sidhu is the main accused inciting the incidents of violence at the Red Fort. The police had sought ten days of custody, saying that there are videos in which Sidhu can allegedly be seen at the scene. Police said that in such a case it is necessary to interrogate the other accused for their identification and arrest.

The investigating officer alleged, 'He was instigating the mob. He was also one of the main rioters. Several social media accounts need to be searched to identify co-conspirators. It was also given his permanent address in Nagpur but would have to go to many places in Punjab and Haryana to bring more details. ' He also alleged that Sidhu is seen entering the Red Fort in the video with his teammates and was present there when the flag was waved.

Police alleged, 'He is seen coming out with the person who hoisted the flag. He is seen congratulating her. He came out and stirred the crowd there. He is the main conspirator. He provoked the mob, which led to violence. Many policemen were injured in the violence. However, Sidhu's lawyer said that since the police already have video and CCTV footage, there is no need to get anything from the accused, so 10 days of detention is not necessary. At this, the judge asked the investigating officer in the court and decided how many days of detention were required and why.

Half an hour later, the investigating officer told the court that police were seeking ten days of custody as the mobile phones and laptops which were allegedly used to put videos on social media were to be recovered. He also said that the police need to visit Mumbai and other places and make the accused face to face with video so that other rioters can be identified.

Significantly, on January 26, thousands of protesters broke into the farmer's block and entered the national capital, and clashed with their police personnel at other places including the ITO. Many protesters came to the Red Fort driving a tractor and entered the historic monument and put a religious flag on its ramparts. More than 500 policemen were injured in the violence on Republic Day, while a protestor was killed.
