
The Supreme Court said, in a heinous crime having a grave impact on society, FIR cannot be quashed on the ground of agreement between the victim, the offender, or the complainant. If this is done then a dangerous precedent will be set and people will file complaints just to extort money from the accused.
A bench of Justice Indira Banerjee and Justice V Ramasubramanian said, "Not only this, after committing crimes like rape, murder, dowry harassment, financially strong accused will settle by paying money and escape the law." The bench set aside the orders of the Gujarat High Court. These include an order in which the FIR lodged in March 2020 on the charge of abetment to suicide was quashed.
Supreme Court orders to send a son to America to father
The Supreme Court ordered a Bangalore-based woman to send her 11-year-old son to the US with her estranged husband. The apex court said it is necessary for the supreme interest and welfare of the child that he should stay with his father in his ancestral home.
A bench of Justices AM Khanwilkar and CT Ravikumar set aside the order of the Karnataka High Court which had refused to hand over the custody of the child to the father residing in the US. In this case, the 11-year-old boy is a normal US citizen and also holds a US passport, the bench said. Her parents also have a US permanent residency card. Justice Ravikumar said the High Court did not pay attention to these aspects in its order.
No criminal action if Ayush doctor prescribes allopathy medicine
Madras High Court has said that if doctors of the Indian system of medicine (Ayurveda-Homeopathy etc.) Justice RMT Tika Raman passed the order on the appeal of a homeopath doctor. A charge sheet has been filed against this doctor of Salem for prescribing allopathy medicines.
The court said that the Director General of Police of the state had issued a circular in 2010 that doctors of the Indian system of medicine will not be harassed even if they use allopathic medicines. Therefore, criminal proceedings cannot be initiated against this doctor.
