A five-member Constitution bench will now hear the dispute over control of rights between Delhi and the central government. The Supreme Court has agreed to constitute a five-judge Constitution Bench to hear the matter. The Delhi government is demanding complete control over the officers, including transfer posting. Solicitor General Tushar Mehta on behalf of the Center had demanded to refer the matter to the Constitution Bench for a hearing.

 

During the hearing held today, advocate AM Singhvi, appearing for the Aam Aadmi Party, said, there is a need for an urgent hearing on this issue. He said this matter is very important. And it should be listed. To this, the CJI said, "We will list it at the earliest."

On 28 April, the Supreme Court reserved its order on the plea of ​​the Center. The Delhi government strongly opposed the petition of the central government. Let us tell you that on May 6, the top court referred the issue of control of services in Delhi to a five-judge Constitution Bench.

 

At present, the right of transfer-posting is with the LG.

 

Let us inform you that after the amendment in this matter by the Central Government last year, the right of transfer-posting of officers is with the LG i.e. the Lieutenant Governor. It is noteworthy that during the last hearing, Solicitor General Tushar Mehta had said on behalf of the Center that this matter is also related to the amendment to the Delhi Act.
