Gyanvapi Case: SC refuses to hear the demand for the worship of Shivling and carbon dating in Gyanvapi Masjid, said- demand from the lower court

Vishwanath Gyanvapi Controversy: The Supreme Court has postponed the hearing of the Kashi Vishwanath-Gyanvapi controversy to the first week of October. The bench of 3 judges of the Supreme Court said that whatever has to be said in this matter, it should be said in the court of the district judge of Varanasi.

 

In the Supreme Court today, the petition of the Anjuman Prajataniya Mosque Management Committee was engaged for hearing. Earlier, the matter was heard on May 18. On that day, the Supreme Court ordered to transfer the entire case from the Court of Civil Judge Senior Division to the Court of District Judges. In that order, the court had also said that the District Judge should first hear the application of the Masjid Committee, in which the petition of the Hindu side has been declared unfit for hearing.

Apart from Anjuman Prajataniya, today 3 more petitions were engaged in the Supreme Court. These were entered by different Hindu devotees. A bench of Justices DY Chandrachud, Surya Kant, and PS Narasimha first heard Huzaifa Ahmadi, counsel for the mosque side. Ahmadi said that according to the previous order of the Supreme Court, action is going on in the Varanasi district judge's court. At present, the issue of maintainability (whether or not the petition of the Hindu side is maintainable or not) is being heard.

 

Next hearing is in October

 

Huzaifa Ahmadi further said that he has also challenged the appointment of the court commissioner in the case. How the commissioner was appointed and the survey of the mosque premises was done was wrong. Ahmadi said that neither the civil judge nor the High Court heard his protest in this regard.

 

 

On this, the bench proposed that he may ask the district judge of Varanasi to hear this aspect as well. But Ahmadi insisted that the Supreme Court should listen to it as the High Court had heard it and dismissed it. The 3-judge bench did not comment on this. The judges said that the hearing is going on in the Varanasi court. In such a situation, it would not be right to hear them on any aspect of the matter now. Therefore, the hearing is being postponed to the first week of October.

After this, petitioner Rajesh Mani Tripathi, who was seeking permission to worship the Shivling found on the mosque premises during the survey, tried to make his point. On this, the bench's chairman Justice Chandrachud said- When the hearing is pending in the lower court, how can you directly petition the Supreme Court? There is a process of hearing a civil case. better you withdraw the petition

 

After this, lawyer Harishankar Jain, on behalf of 7 devout women including Amita Sachdev, and Parul Kheda, demanded carbon dating of Shivling. But the judge also told him that in this way the hearing cannot be held directly in the Supreme Court. They should keep these things in the lower court.

 

Seeing the stand of the judges, the devotees withdrew their petitions

 

The petition of Shailendra Kumar Pathak Vyas of the Vyas family, who has been worshiping in the Vishwanath temple for hundreds of years, was also listed before the court. In this, it was told that till 1993 he had control over a basement of Gyanvapi. There used to be programmed like worship and Ramayana lessons. But seeing the stand of the judges, all the devotees withdrew their petitions. Everyone has said to keep their point in the lower court.
