In a Himachal Pradesh court, the judge refused to give bail to the rape accused, saying 'no means no'. The man is accused of raping a 17-year-old girl and had argued in court that he knew the girl and the two had a mutually consensual relationship. The court also said that such a simple sentence is the most difficult for some men to understand.
The accused was arrested on December 18 last year after he filed an FIR on behalf of the minor victim in Rajgarh, Himachal Pradesh.
According to the allegation, on December 17, the victim was waiting for the bus, and then the accused offered to leave her in her jeep till the house. When the victim was sitting in the jeep, the accused allegedly changed the path of the car and took it to a deserted area, and raped her.
Judge Anoop Chitkara in his order mentioned that the girl had said 'no' to the accused. However, the accused wants to have a forced relationship with the girl and also proposes marriage to her. When the girl refused, the accused allegedly raped her and left her on the street. After this, the girl reached home by bus and told her to demand the whole incident after which the family lodged an FIR.
Judge Chitkara said, 'No means no - this simple sentence is what some men find most difficult to understand. No does not mean yes, it does not mean that the girl is shy, it does not mean that the girl wants the boy to celebrate her, it does not mean that the boy will have to follow the girl. The word 'no' does not need explanation or authenticity. It ends at this point and the man has to stop. '
While giving the order, the judge also said that the girl refused to touch the boy but he did not agree. There is neither will nor desire to feel each other anywhere in it. The judge also said that if the girl wanted to, she could easily hide all this from her family members, but she did not do so, which indicates the truth of the matter.
