Waqf Bill: If the Waqf Bill is passed in the Rajya Sabha, the Muslim Personal Law Board will go to court, questions raised on Nitish-Naidu

Maulana Khalid Rashid Firangi Mahali, a member of the All India Muslim Personal Law Board, said that if the Waqf Amendment Bill is passed in the Rajya Sabha, the Personal Law Board will go to court and challenge the bill. We hope that we will get justice because our stand is on constitutional facts. He said that the Muslim community had hoped that Nitish Kumar's party Janata Dal United and Chandrababu Naidu's party Telugu Desam Party would oppose the bill, but this did not happen.

He said that it would have been better if all the parties had strongly opposed the bill with strong facts. If the bill is passed in the Rajya Sabha, the Personal Law Board will challenge it in court.

Now the District Magistrate will be authorized to make decisions on Waqf properties.

After the passing of the Waqf Amendment Bill, 98 percent of the Waqf properties in UP are in danger. So many Waqf properties are not yet registered in the revenue records. In their cases, now not the Waqf Board, but the concerned District Magistrate will be authorized to make decisions. At the same time, the 57792 government properties on which the Waqf Board is staking its claim, these properties will also be out of their jurisdiction now.

In Uttar Pradesh, since independence, there has been a big game in the name of Waqf properties. According to a confidential report of the Minority Welfare Department of UP, the Waqf Boards have also registered the lands of public use as Waqf. Even in many districts including Rampur and Hardoi, cases of wrongly registering private land as Waqf property are coming to the fore. Now the District Magistrate will hear these disputes and will give a decision based on the revenue records of Fasli year 1359 i.e. 1952.

The area of Waqf properties in UP is 11712 acres.

In UP, 57792 government properties are illegally registered as Waqf properties. Their area is 11712 acres. As per the rules, these properties could not be Waqf. These properties are located in all the districts. As soon as the amended law comes into force, these properties will go out of the purview of Waqf in one go. The local administration will just have to take possession of them on the spot.
