Union Law Minister Kiren Rijiju pitched for institutional arbitration, pointing out flaws in ad hoc arbitration. Said that Artificial Intelligence (AI) can be helpful in this task. It can assist arbitrators with tasks such as document review and analysis, legal research, and award drafting.
Union Law Minister Rijiju was addressing the Delhi Arbitration program organized in the High Court on Sunday as the chief guest. He said that most people prefer ad hoc arbitrations, where the proceedings are not governed by pre-determined rules. Therefore, the proceedings are susceptible to court intervention at various stages.
The judiciary should have cooperated
Emphasizing institutional arbitration, he said that new arbitration centers must be set up in non-metro cities. Citing World Bank's EODB report, he said that India takes 1,445 days to resolve a dispute and 31 percent of the claim value for dispute resolution is spent during the process.
Kiren Rijiju said that the judiciary must be cooperated to achieve the objectives of ease of doing business and ease of living. Courts should be paperless. In the new Union Budget, an average of Rs 1,000 crore has been allocated for the third phase of the e-court project.
The international community had come to the virtual system during the Corona period
At the Justice Kaul event, Supreme Court Justice Sanjay Kishan Kaul said that virtual court hearings have increased efficiency and it is necessary to use this system through huge infrastructure. India being a developing country faced infrastructure and connectivity issues but it did not take long to find a way to operate efficiently. Regarding artificial intelligence tools, he said that the apex court has constituted an AI committee, which is looking into various aspects.
