A piece of shocking news has come out from Nalanda, the home district of Chief Minister Nitish Kumar in Bihar. There a person was living in the house of an elderly person for 41 years as his son. When the court decision came out in this hearing that was going on for 40 years, people were forced to press their fingers under their teeth.

In this whole episode, there is a story of betrayal, playing with the spirit of a family, and going to the extreme in the greed for property, which is no less than the script of a film.

The court's decision has come after 40 years of a legal battle in this dispute of property and inheritance. In this case, the vicious culprit has got only three years' imprisonment.

The court of Nalanda has sentenced Dayanand Gosain, who lived in the house for 41 years, after finding himself guilty of cheating by replacing the missing son of about 16 years.

What's the matter?

This episode started from Morgaon of Silao police station area of Nalanda district. The case is related to the property of late Kameshwar Singh, owner of about 150 bighas of land in the village.

The tragic turning point in his life came when his only son Kanhaiya Singh went missing in the year 1977 while appearing for the matriculation examination. After a lot of research, a case was registered at the Silav police station.

More than four years had passed in the hope of an only son.

Kanhaiya came as a monk

Meanwhile, in 1981, a young sadhu came to the neighboring village of Keshopur. According to the local people, the young sadhu kept calling himself the missing Kanhaiya and publicized it a lot.

Within a few days, this word spread like wildfire. Father Kameshwar Singh was alive at that time.

He believed in the words of this young man and some others and brought him to his house.

Although his late wife Ramsakhi Devi refused to accept him as her son, she remained silent due to pressure from the villagers.

Dayanand Gosain started living at home as the only heir to Kanhaiya Singh. But Mother Ramsakhi Devi did not consider him Kanhaiya and continued to distrust him.

Finally, in November 1981, when his patience was answered, he filed a case against Dayanand at the Silav police station.

The title suit took place in Patna District Court in November 1991. Meanwhile, in 1995, Kameshwar Singh and his wife Ramsakhi Devi died.

After the death of the mother, the daughter took the lead

After the death of the parents, the further legal battle was continued by Vidya Devi, sister of Miss Kanhaiya Singh. An attempt was made to know the side of Vidya Devi in this regard, but she could not be contacted.

However, his lawyer Rajesh Kumar believes that all this is related to a property grab.

Rajesh Kumar told the BBC, "During almost four decades of living in Kameshwar Singh's house, Dayanand sold about 50-55 bighas of land. He also got compensation for laying the pipeline. He also got married."

"The case was registered by Kanhaiya's mother. His mother had given a statement in her testimony that Kanhaiya had a mark of injury on his head which was not on Dayanand's head. Also, he did not appear for the DNA test."

fake certificate

A man from the same village in Jamui district where he belonged told the court that he was the third son of Prabhu Gosain. The most shocking fact, in this case, was the death certificate of Dayanand Gosain submitted by him in court.

The death of Dayanand Gosain has been mentioned in the certificate as 1981. But this certificate was issued in 2014. It was investigated under the directions of the court, and it turned out to be fake.

From the district court, the matter reached the Supreme Court via Patna High Court and on the instructions of the Supreme Court, the hearing of the matter started again.

After hearing the arguments, the Nalanda District Court sentenced Dayanand Gosain to three years imprisonment and a fine, terming it as a forger.

On the other hand, Nalanda's District Prosecution Officer Rajesh Kumar Pathak says, "Since 2014, there was a demand for a DNA test from the prosecution, on which in 2022 the court refused to get the test done by applying in writing. Also, the accused Could not tell where he was living between 1977 and 1981."

Vidya Devi, daughter of late Kameshwar Singh, said, "Those who would have been happy have gone. The mother's wish was that the matter should be exposed. We tried to bring out the truth and the result is in front of everyone. There is no greed."

On the other hand, after the court's decision, Dayanand Gosain said during a conversation with the local media, "All this is being done for the property. Sisters are eyeing the property, so it has been done."
