'Modi ji himself brought a bill against himself... Shah spoke on the bill for dismissal of PM-CM; he took a jibe at the opposition

Union Home Minister Amit Shah has said that the Constitution (130th Amendment) Bill, 2025, will definitely be passed, even though the opposition is fiercely opposing it.

This bill proposes that if the Prime Minister, Chief Minister, or any minister remains in custody for 30 consecutive days under a serious crime, which is punishable by five years or more, then he will have to step down from his post.

Shah said that this bill is to maintain "constitutional morality" and public confidence. It will apply equally to all leaders including the ruling party.

Amit Shah defended the bill, saying that it is not to target any particular party or leader.

He expressed confidence that many people from the Congress and the opposition will "support morality" and support the passage of this bill. The bill has been sent to the 31-member Joint Parliamentary Committee (JPC) for detailed scrutiny, which will give suggestions on it.

'Morality will win'

Amit Shah said, "I am sure that this bill will be passed. Many people in Congress and the opposition will support morality and maintain moral ground."

Praising Prime Minister Narendra Modi, he said, "The Prime Minister himself has included the post of PM in this bill. Earlier, Indira Gandhi had brought the 39th amendment and protected the President, Vice President, Prime Minister, and Speaker from judicial investigation. But Narendra Modi ji has brought a constitutional amendment against himself that if the Prime Minister goes to jail, he will have to resign."

Amit Shah rejected the opposition's allegation that the government is trying to destabilize non-BJP governments through this bill. He said that the courts will prevent the misuse of this bill.

The Union Home Minister said, "Our courts understand the seriousness of the law. When a resignation has to be given after 30 days, before that, the court will decide whether the person should get bail or not. When Arvind Kejriwal's case went to the High Court, it was said that he should resign on moral grounds, but there is no such provision in the current law."

My party and the country's Prime Minister believe that no Chief Minister, Minister, or Prime Minister can run the government while being in jail... When the Constitution was made, the Constitution makers would not have imagined such shamelessness that a Chief Minister remains in jail and remains the Chief Minister from jail. - Amit Shah, Union Home Minister

'No one targeted'

On the sharp attacks of the opposition, Shah clarified that this bill is not against any particular party or leader. He said, "Anyone can go to the court and ask for an order to register an FIR. During the UPA government, many investigations were started on the orders of the court. I can tell at least 12 such cases where the court had directed the CBI to investigate."

Referring to Aam Aadmi Party convenor Arvind Kejriwal, Shah said, "He got bail within 30 days, and I believe he should have resigned then. When people opposed him, he resigned. Now he has to resign legally."

Shah also made it clear that the bill is fair. If a leader gets bail even after 30 days, he can return to his post after taking the oath.

We are giving the opposition a chance: Amit Shah

On Trinamool Congress (TMC) boycotting the JPC, Shah said that the government has given them a full opportunity to join.

He said, "What can we do? We are asking them to join and participate. It is not right to reject the rules of Parliament and expect that everything will happen on their terms. The government is giving them a chance, but if they do not accept it, what else can we do? If they do not join the JPC, what should we do?"

Shah stressed that the JPC is important and it should include the views of all parties. Shah said, "This is an important bill, and the views of every party should be heard in the JPC. If the opposition does not support this bill for the next four years, will the country's work stop? This will not happen. We are giving them a chance to give their opinion, and if they do not do so, the public is watching everything."
