The Supreme Court will hear petitions against the constitutional validity of the Waqf (Amendment) Act 2025 on Thursday. Chief Justice BR Gavai and Justice Augustine George Masih will hear the case. Earlier, a bench of former CJI Sanjiv Khanna, who retired on May 13, was hearing it.

Will not make appointments in the Central Waqf Council and Boards

Earlier on April 17, the Supreme Court recorded the Central Government's assurance that it would not denotify Waqf properties, including Waqf by User, until May 5 and would not make appointments to the Central Waqf Council and Boards.

This assurance was given when the Supreme Court was told that the law was passed by Parliament after due deliberation, and it should not be stayed without hearing the government's side.

The Center opposed the Supreme Court's proposal.

The Center has opposed the Supreme Court's proposal to pass an interim order against the denotification of Waqf properties, including Waqf by User.

Preliminary affidavit filed

On April 25, the Union Ministry of Minority Affairs filed a 1,332-page preliminary affidavit defending the Wakf Amendment Act 2025 and opposing any blanket stay by the Court on a law passed by Parliament that has the presumption of constitutionality.
