The Union Home Ministry on Tuesday introduced the Immigration and Foreigners Bill in the Lok Sabha. The aim of this bill is to modernize and strengthen the existing immigration law of India. With its help, it will be easy to deal with illegal intruders and keep an eye on foreigners staying longer than the prescribed limit.

 

Let us tell you that the problem of illegal infiltration in India has become severe in the last few years. Bangladeshi and Rohingya infiltration is the biggest issue. There is a fear of not only a threat to national security but also a burden on resources.

 

Illegal infiltration will be curbed.

 

The new bill provides for strict punishment and heavy fines. Foreigners will have to pay a heavy fine for violating visa conditions. The process of sending back illegal intruders has been simplified.

 

This bill will allow the government to allow or not allow any foreigner to enter the country in case of a threat to the security and sovereignty of the country. The bill also allows collecting biometric information of a foreign person. After passing, this bill will replace the existing four laws.

 

These laws will be replaced.

 

Passport (Entry into India) Act- 1920.

 

Registration of Foreigners Act- 1939.

 

Foreigners Act- 1946.

 

Immigration (Carrier Liability) Act- 2000.

 

Provision of arrest without warrant

 

According to the bill, if a person enters India without valid documents, then there is a provision to arrest him without any warrant. Now, on coming to India, it is mandatory for foreign citizens to immediately register themselves with the concerned registration officer.

 

Institutions will have to give information about foreigners.

 

The new bill also provides that the concerned institution will give information about the foreign person to the registration officers. If a foreign citizen is in a hospital, hotel, or other institution, then it will be the responsibility of that institution to give its information to the concerned authorities. This rule will also apply to universities and educational institutions.

 

Entry without documents will cost heavily.

 

If a foreign citizen enters India without valid documents, then he may have to face a jail term of up to five years and a fine of up to Rs 5 lakh. If the passport and other documents are fake, a fine of 1 to 10 lakh rupees can be imposed. Under the current Passport Act, if a foreigner enters without a valid passport, there is a provision of 5 years imprisonment or a fine of 50 thousand rupees or both.

 

The carrier will also be fined.

 

The new bill provides for a fine of 2 to 5 lakh rupees on the carrier who brings illegal people to India without valid documents. In case of non-payment of the fine, the immigration officer will seize the property related to the ship or the carrier and recover the fine. Under the current Immigration (Carrier Liability) Act- 2000, there is a provision of a fine of up to one lakh rupees on the carrier.
