Gyanvapi Case: Masjid Management Committee demands improvement in the previous order from SC, Gyanvapi Committee's petition restored

The Gyanvapi Masjid Management Committee (GMMC) mentioned its application before the Supreme Court seeking modification of the top court's Monday order. In which the appeal of the committee questioning the demand of the Hindu side demanding the right of worship inside the mosque was disposed of.

 

A bench headed by Chief Justice DY Chandrachud asked senior advocate Huzefa Ahmadi, appearing for the mosque committee, to inform Solicitor General Tushar Mehta so that he can appear before the bench.

 

 

Supreme Court restores Gyanvapi committee's petition

The Supreme Court on Wednesday restored the Gyanvapi Samiti's petition, which it had inadvertently disposed of on July 24 while staying at the Archaeological Survey of India (ASI) work in the mosque complex. The ASI was surveying to find out whether the mosque was built over a temple that was there earlier.

 

A bench of Chief Justice DY Chandrachud, Justice JB Pardiwala, and Justice Manoj Mishra took note of the submissions of senior advocate Hufeza Ahmadi, appearing for the Anjuman Intejamia Management Committee of Gyanvapi Masjid, that the court had disposed of the main petition instead of its interim petition seeking stay on the work of the ASI on the last date of hearing.

 

Solicitor General Tushar Mehta, appearing for the Uttar Pradesh government and the ASI, said he had no objection to the restoration of the special permission petition of the mosque committee.

 

In the main petition, the Masjid Committee has sought dismissal of the suit filed by the Hindu side in the Varanasi District Court under Rule 8 11 (c) of the Civil Procedure Code for filing it on paper without duly stamped and authorized signatures.

 

Hearing in Allahabad High Court on ASI survey

At the same time, a hearing is going on on the petition filed in the High Court against the survey of the Kashi Vishwanath Gyanvapi campus by the Varanasi District Court. Anjuman Intezamia Masajid has challenged the order of District Judge Varanasi to allow scientific surveys in the High Court. Naqvi, the lawyer for the Muslim side, is arguing. The counsel for the Muslim side and the Advocate General of the state government are also present in the court. The Supreme Court has stayed the scientific survey till 5 pm today. Senior advocate Naqvi argued that the trial court cannot order a collection of evidence to prove the claims of the petitioner.
